1. Acceptance
By creating an account or using Dictate-IT (the “Service”), provided by Tosdra (“we”, “us”), you agree to be bound by these Terms of Service and the linked Privacy Statement. If you do not agree, do not use the Service.
2. The Service
Dictate-IT is a professional AI dictation, polishing, proofreading, and research workflow available through the Web, Microsoft Word (add-in), and Microsoft Outlook (add-in). The Service depends on third-party transcription and language-model providers; their availability is outside our direct control.
3. Subscription & Billing
The Service is offered on a paid subscription basis only. There is no free tier. Subscription terms, pricing, and billing cycles are specified at the point of purchase. Subscriptions renew automatically unless cancelled before the end of the current billing period. No refunds are issued for partial periods unless required by applicable law.
4. Acceptable Use
You agree not to use the Service to dictate, transmit, or generate content that is unlawful, infringes the rights of others, contains malware, or violates the acceptable-use policies of our subprocessors. We may suspend or terminate accounts that breach this section.
5. User Content & Intellectual Property
You retain all rights in the audio you dictate and the transcripts and documents produced. We claim no ownership over your content. The Service software, design, and brand remain our intellectual property. The Service is licensed to you, not sold.
6. Privacy
Our handling of your data is described in the Privacy Statement, which forms part of these Terms.
7. Disclaimer & Limitation of Liability
The Service is provided “as is”. To the maximum extent permitted by law, we disclaim all implied warranties and shall not be liable for indirect, incidental, special, or consequential damages, including loss of data, profits, or business opportunities, arising from your use of the Service.
8. Termination
You may cancel your subscription at any time from your account. We may suspend or terminate access for breach of these Terms, non-payment, or where required by law.
9. Governing Law
These Terms are governed by the laws of the Federal Republic of Germany. Exclusive jurisdiction lies with the competent courts in Germany, to the extent permitted by mandatory consumer-protection law.
10. Changes
We may update these Terms from time to time. Material changes will be communicated by email or in-app notice at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance of the revised Terms.
